For Scott Bauer, problem solving is second nature. And as a commercial litigator, Scott understands that hard decisions are a necessary part of everyday life.  

Scott appears before state and federal courts, and administrative agencies, for clients ranging from startups to major national corporations. During a career spanning more than two decades, he has successfully advised hundreds of clients on antitrust claims, business torts, contract disputes, director and officer liability, employment, environmental, intellectual property, product liability, and securities matters.

Detailed and efficient, Scott serves as a strategic advisor, defender, and advocate, committed to the preservation of clients' business goals. He is equally skilled resolving disputes through trial, arbitration, mediation, and negotiation.

On weekends, Scott, with his teenage children, enjoys sports, music, and trips to the Colorado outdoors. Scott's favorite authors are Kurt Vonnegut and Robert Ludlum and he enjoys reading nonfiction from his extensive military history collection.

Guzman v, Murphy, (Bankr. D. Colo.).  Trial concerning the existence of an implied easement to commercial property in an adversary proceeding in bankruptcy,

April 2007
Virtual Cloud Services, Inc. v. CH2M Hill, Inc. (D. Colo). Four-week jury trial in a case alleging misappropriation of trade secrets, breach of fiduciary duty, and breach of covenant not to compete and non-disclosure agreements. Represented plaintiff, a high-tech start-up company.

April 2006
First Horizon Merchant Services, Inc. v. Thoma Cressey Equity Partners, Inc., et al (Denver Dist. Ct.). Twelve-day trial in an action by a creditor of an insolvent corporation to recover from the debtor's directors and from its parent, a venture capital fund. Claims included piercing the corporate veil, fraud, breach of fiduciary duty and unjust enrichment. Represented the private equity fund and the directors of the debtor. Summarized at 2006 WL 2708500.

April 2005
Bambei v. Comcast (AAA Arbitration). ERISA action concerning recovery of Change in Control Severance Benefits for a high-level executive at AT&T Broadband, which merged with Comcast.
